SA:Bad weather not a factor in chopper crash

ADELAIDE, Aug 23 AAP - Bad weather was not a factor in the crash of a helicopter near
Lake Eyre last week which killed three experienced ABC television newsmen, a report has
found.

An initial Australian Transport Safety Bureau (ATSB) report released on Tuesday said
conditions were fine and clear in the area when the Aerospatiale Industries AS355 chopper
went down in South Australia's north on Thursday night.

Journalist Paul Lockyer, cameraman John Bean and their pilot Gary Ticehurst died in
the crash, which left a 60-metre wreckage trail in an area of the Cooper Creek, about
145km north of Marree.

A small memorial service was held near Lake Eyre for the trio soon after the crash
while the ABC said a more substantial service was planned for Bean in Brisbane on Monday.

It said the Brisbane Convention and Exhibition Centre service would be open to the public.

The ATSB said last week's incident was the first fatal crash in Australia involving
an AS355 helicopter and the first since 1986 involving a twin-engined chopper.

The report said the wreckage trail indicated the aircraft was travelling east at the
time of impact and that much of the wreckage was damaged by a fire after the crash.

"The on-site examination is continuing and several components will be recovered from
the site for technical examination," the ATSB said.

"These include both engines, a number of components from the helicopter's flight control
system, some of the flight instruments and the helicopter's global positioning system
unit."

The four ATSB investigators sent to the site interviewed a number of witnesses and
will check the helicopter's maintenance and airworthiness records, its operational information,
records of the pilot's experience and his medical status.

The bureau said at the time of the crash there were 10 AS355 helicopters registered in Australia.

The ABC's chopper was built in 1988 and first registered in February 1989.

A further preliminary report on the cause of the crash will be released within 30 days.

The ATSB was also investigating the forced landing of a charter plane with six people
on board near Lake Eyre on Tuesday morning.

It said the plane suffered a loss of power at about 11.45am (CST).

No-one was injured, with a helicopter expected to retrieve the pilot and five passengers.

NSW:$5.2bn 'black hole' in NSW budget

SYDNEY, April 27 AAP - An audit of NSW's public finances is set to reveal the situation
is worse than first thought.

The coalition government carried out an appraisal of the budget after winning the state
election on March 26. That revealed a $4.5 billion shortfall.

However the amount has risen to $5.2 billion, an audit by acting Treasury Secretary
Michael Lambert, due to be released on Wednesday, will reveal.

The Solar Bonus Scheme, which pays householders for feeding solar energy back into
the grid, is being blamed for the additional $700 million blowout.

Labor attempted to "hide" the overall shortfall by directing the state Treasury to
bring forward hundreds of millions of dollars from rail grants, News Ltd reported.

"The black hole that Labor has left ... has now blown out to around $5.2 billion,"

NSW Premier Barry O'Farrell was quoted as saying.

"And I fear it could grow even further as we continue to review other financial issues."

MELBOURNE, Feb 11 AAP - Victoria Police have charged a man in relation to a shooting
death at a farm in northern Victoria.

Homicide Squad detectives charged Darryn Cassidy, 44, with one count of murder at an
out of sessions court hearing in Swan Hill late on Friday.

Earlier police had said a man in his 40s had walked into the Kerang police station
on Friday morning and told officers he had been involved in a fatal shooting.

Police attended a farm in Lower Loddon Road, Kerang, on Friday where a man's body was found.

The accused was remanded in custody and is due to face Bendigo Magistrates Court on Monday.

Fed:Economic growth to accelerate above trend in 2010:Westpac

Economic growth figures for this year look set to put more pressure on the Reserve
Bank to raise interest rates again.

The Westpac-Melbourne Institute leading index for February .. released today .. measures
7.2 per cent .. well above its long-term trend of 2.8 per cent.

The index .. which indicates the likely pace of economic activity three to nine months
into the future .. grew at its fastest pace since 1997.

Westpac chief economist BILL EVANS says it's a stronger outlook than Westpac's current
forecast for growth.

It's also stronger than the trend growth pace for this year which the Reserve Bank
board forecast in the minutes of its April board meeting .. released yesterday.

MELBOURNE, Dec 7 AAP - A Canadian citizen who has lived in Australia for 10 years fears
he will die if he is deported on Wednesday.

Ziad Chebib, 49, was told on Monday he will be flown to Vancouver, leaving a son, daughter
and grandson behind in Melbourne.

Mr Chebib, a Lebanese-born Canadian national, was detained in Melbourne last week and
a meeting with immigration officials on Friday brought him no relief.

"If they move me out of here, I'll die," he told AAP.

"I've got heart murmurs, I've not eaten in six or seven days. All the pressure on the
plane, I can't do it."

Mr Chebib has been on a hunger strike since last Wednesday and has accused the government
of disregarding its humanitarian responsibility.

After arriving in Melbourne from Calgary with his wife Salime and his four children
in 1999, he lost his bid for permanent residency because he failed to satisfy the income
requirements of the business visa.

An immigration department spokesman said last Friday Mr Chebib had been granted 23
bridging visas since June 2008 on the basis of his stated intentions to leave Australia.

Mr Chebib says he has asked the Canadian government for help and will also campaign
at the Australian High Commission in Ottawa, but the department of immigration says he
has run out of chances.

"He has exhausted all appeal processes and will be removed," a department spokesman said.

"He's used every avenue including ministerial intervention and has been turned down six times."

Mr Chebib fears he might suffer the same fate as Scotsman Andrew Moore who died two
days after being deported despite having lived in Australia for 30 years since the age
of 11.

Mr Moore was deported after a string of criminal convictions and was found dead on
a footpath in London in October, Fairfax newspapers reported on Monday.

"I have $20.15, I don't have anything all. All I'm taking is my hunger strike," Mr Chebib said.

But the immigration department said there was provision to grant Mr Chebib a destitution
allowance and had arranged to assist him in his onward journey to Toronto, where he has
a son.

He has another son, daughter and grandson in Melbourne - all of whom are Australian
citizens - while his wife Salime and eldest son Tarek, 29, are in Lebanon.

He said his wife and son, who suffers bi-polar disorder, were forced to Lebanon in
July by pressure from the immigration department.

Mr Chebib said he will be escorted back to Canada by two staff from the department
of immigration and three from the NSW police.

WA: Seven West Australians cleared of swine flu

Seven of the 11 West Australians being tested for the deadly swine flu have now been cleared.

WA Health's Dr PAUL EFFLER said results for the four other people being tested could
be available as early as tomorrow.

Dr EFFLER says those tested have been instructed to stay indoors .. sleep apart from
their partner .. wash their hands before preparing food and not go out shopping.

He's encouraged other West Australians who've recently travelled to areas like the
Americas to contact their GP if they develop flu-like symptoms.

VIC: Verdict quashed for man accused of killing two friends

MELBOURNE, Aug 18 AAP - A man who was driving a ute in which two friends were killed
when it crashed in Victoria while they were out rabbit hunting has had his conviction
quashed and a new trial ordered.

Paul Jacob Poduska was driving a ute that rolled down an embankment, killing James
Herbert, 26, and Kale Shaw, 18, north-east of Melbourne on February 7, 2004.

In November last year, Poduska was found guilty by a jury on two counts of culpable
driving causing the death of another person.

He was sentenced to a three-and-a-half-year jail term, with a minimum two years, in
the Victorian County Court.

The Victorian Court of Appeal today ordered Poduska be acquitted and a new jury trial held.

The dead men had been riding in the tray of the ute Poduska was driving on the vineyard
he was a manager at in Tarrawarra.

The three appeal justices said the facts of the case were not in dispute - that Poduska
and his mates had been drinking the night before and decided to go out rabbit hunting
early in the morning.

They were driving on rough terrain and in the darkness, but it was accepted that Poduska
was driving slowly.

All the justices agreed the original guilty verdict could not be supported once all
the evidence was looked at.

They also said the original trial judge failed to fully identify to the jury Poduska's
conduct upon which the Crown relied to prove its case.

Justice Phillip Mandie said: "... it was not open to a reasonable jury to be satisfied
beyond a reasonable doubt that the appellant, in driving the utility, had failed 'unjustifiably
and to a gross degree to observe the standard of care which a reasonable man would have
observed in all the circumstances of the case'."

The justices said the law required Poduska, in his driving, be seen as negligent to
a 'gross degree' for a guilty verdict to be upheld.

In deciding a new trial should be held, the judges said the original trial judge was
right to rule there was a case to answer and it is not at issue that the applicant was
the driver of the vehicle that killed two men.

Poduska has so far served nine months of his original jail term.

SYDNEY, April 11 AAP - NSW Premier Morris Iemma is right to promise public funding
for elections, but the reform will be pointless if loopholes remain for union-linked donations
and grants, The Sydney Morning Herald says in today's main editorial.

The NSW government has given the Transport Workers Union grants worth more than $700,000
over the past six years, and in the same period the union has donated $746,288 to the
Labor Party, the editorial says.

Most of the money came from WorkCover and was apparently to fund unspecified "projects"

in occupational health and safety. The minister responsible, John Della Bosca, insists
the grants were at arm's length and rigorously audited.

But audits usually involve no more than a sample of records, and such expenditure should
be fully receipted and on the public record, the editorial says.

"Then there is the broader question of why unions should be getting union funds at all," it adds.

"If public funds are to be spent it should be on programs for all, not just union member,
who make up just one-fifth of the workforce."

Even if the grant money is properly spent, the public money spent on union activities
frees up funds to spend on something else - like donations to the ALP, it says.



If life is a gamble, the trick is to make sure the odds are tilted in your favour,
says Sydney The Daily Telegraph in an editorial today.

"When it comes to poker machines, they are not," the paper says.

The "massive concentration" of poker machines in western Sydney has become a problem,
reflected in the gigantic sums of money local residents put through the machines.

On average every Bankstown resident spends $1500 a year on the pokies. In Canterbury
the amount is up to $1782 a year.

"Western Sydney is a region under genuine mortgage pressure. Residents may therefore
be more inclined than otherwise to chase the long odds of a big mortgage-clearing pokie
win," it says.

"Worried people do worrying things."



With the US economy expected to slip into recession this year, Australia is the only
English-speaking country with economic growth in the three per cent range - but the good
times can't last, says The Australian in today's main editorial.

"It used to be said that when the US sneezed, Australia caught pneumonia. But we sidestepped
the tech wreck in 2001 because our housing market had begun its long boom," the editorial
says.

"Now the good fortune is coming from an even longer boom in the mining sector."

But the International Monetary Fund warns that the laws of gravity will eventually
kick in, with a fall in commodity prices.

"The $1 trillion question is whether the Australian economy is already slowing more
dramatically than the IMF realises," the editorial says.

The federal government should press ahead with spending cuts to give it the flexibility
to return larger tax cuts to voters to prevent the economy falling too far, it says.

It is also important that Treasurer Wayne Swan be upfront about the risks to the economy
in the long haul, it adds.



Stock market mayhem has raised questions about the competence of market regulators
the Australian Stock Exchange and the Australian Securities and Investments Commission,
The Australian Financial Review says in an editorial today.

"Unlike the courageous competition regulator, ASIC has been silent at a time when the
market needs leadership through enforcement. The Treasurer must be concerned," the editorial
says.

Treasurer Wayne Swan should take a leaf from the book of his US counterpart Henry Paulson,
who has recognised the need for rethinking the structure of US market regulation and devised
a detailed long-term plan, it says.

"Mr Swan should plan to deal with the inherent conflict of interest in the ASX as a
frontline regulator and aim to harmonise Australia's regulations with the best of global
rules.

"In the meantime, he must ensure ASIC uses its teeth to enforce existing disclosure laws."



As the Victorian government profits from restructuring the state's poker machine industry,
it must not forget problem gamblers, the main editorial in the Herald Sun newspaper says
today.

The government is likely to get a "multi-billion-dollar windfall" from auctioning licence
fees when the current system expires in 2012.

"The big losers in the new arrangements announced by Premier Brumby are Tattersall's
and Tabcorp, which are prevented from bidding for the pokies until their current licences
run out," the editorial says.

"But while the government is right to break the lucrative pokies duopoly, it has not
done enough to reduce the social cost of problem gambling."

Anti-pokies campaigner and World Vision Australia chief Tim Costello welcomed the changes
but describes pokies as the "crack cocaine of gambling".

The Victorian government has banned ATMs from venues so gamblers cannot drain their
bank accounts but it remains addicted to pokies revenue, the editorial says.

"Mr Brumby must put more of the profits the government makes from gambling into solving
the problem it creates."



The Victorian government's gaming industry reforms do nothing to assist problem gamblers,
the main editorial in The Age newspaper says today.

The end of the poker machine duopoly in Victoria is "welcome" and the reasons for the
change "seem sound", the editorial says.

"...It is hoped (the changes) will indeed lead to a greater diversity of ownership
and increased competition, as well as giving smaller communities a more direct connection
with putative owners, such as local hotels and clubs."

The changes bring Victoria into line with NSW and Queensland, and show the state's
willingness to embrace the federal government's national approach to gaming-machine control..

"But what of the people who really matter - the ones who don't own poker machines,
or even want to bid for the rights to do so, but who are subject to frequent exposure
to what one gambling expert has called `the most dangerous machines in the world'?

"Victoria has, by the most conservative estimate, 40,000 problem gamblers, a malaise
that, in more than 80 per cent of cases, is associated with electronic gambling machines.

The billions earned from gaming have come at a "tremendous human cost", the editorial says.

SYDNEY, Dec 7 AAP - The NSW Riverina town of Griffith is still hurting after two youths
were jailed for a minimum of less than four years for killing another teenager in an unprovoked
attack, its mayor says.

The two 16-year-olds, who can only be known as CK and TS, were today sentenced to a
maximum of six years by NSW Supreme Court judge Megan Latham for bashing to death the
17-year-old, known as AF, at 3am on January 1 this year.

But with time already served, TS will walk free in 2010 and CK in 2011, after both
pleaded guilty to manslaughter.

AF was set upon at a main street taxi rank by two local youths, then both 15, as he
went to meet friends shortly before 3am on January 1 this year.

"Look at that cockhead," taunted CK.

"What's your staring problem?"

CK, who had been drinking and smoking cannabis at a party near the lake, grabbed AF
and headbutted him forcefully. TS then punched him in the head.

AF took a few short steps before collapsing to the roadway and could not be revived.

Justice Latham today described the attack as "entirely senseless unprovoked and callous."

"CK was in my view spoiling for a fight and TS joined in," Justice Latham said.

"The offenders' physical size and strength belies their age.

"That they could deliberately inflict harm upon another young man who like them, had
family waiting at home to see him, a future to look forward to, a life full of promise,
for absolutely no reason at all beggars belief."

Divisions were clear in the courtroom today, with members of AF's family on one side,
and a large group of supporters and family of the offenders on the other.

AF's family were too distressed to speak to waiting media.

Griffith mayor Dino Zappacosta said the crime had divided the community, and many people
were still struggling to accept the loss.

"There's still people hurting at the moment," Mr Zappacosta said.

"The friends of (AF) are still in shock and going through a lot of emotional upheaval.

"We have spent the last 12 months building community confidence in how we can go forward."

Mr Zappacosta said the sentences would receive a mixed response.

"I'm conscious that there will be people who will not accept these sentences," he said.

"However, taking into account the age of the boys concerned I think we should be tolerant
and respect what's happened. I think we should allow the judicial system to play its part."

AF's family and friends recently laid a memorial plaque at the spot where he died in
a private ceremony, and representatives from Griffith's 72 cultural groups had come together
to form an action plan.

The plan, to be launched by the NSW police minister next Friday, aimed to improve conditions
for youths in the town and address law and order concerns, Mr Zappacosta said.

"It is one way that the community were able to come to terms with the death of (AF)," he said.

"Hopefully they will now accept the judicial system's result.

"The only way forward is to unite and show respect, and show condolences to everybody involved."

MELBOURNE, April 24 AAP - Homicide detectives have released the name of a woman found
dead in suspicious circumstances at her unit in Melbourne's south-east over the weekend.

The body of 51-year-old Joanne Elizabeth Howell was found on the ground floor of the
flat in Poath Road, Hughesdale, on Saturday night.

A 52-year-old man arrested and questioned over Ms Howell's death has since been released
without charge.

Police said the cause of death was unknown but was being treated as suspicious.

FED: National Christmas road toll is eight

The Christmas road toll now stands at eight .. less than two days into the national
holiday road count.

In the latest incident .. a four-month-old baby has died after the van it was travelling
in was rear-ended by another vehicle this morning in Sydney's south-west.

The baby was airlifted to the Children's Hospital at Westmead .. but suffered cardiac
arrest and died a short time later.

In Queensland .. a man was killed near Rockhampton .. when his vehicle hit a tree ..

around six this morning (AEST).

And in Victoria a 22-year-old woman has died in a car accident at Cowes on Phillip Island.

She died when the driver lost control of the vehicle and slammed into a tree about
three (AEDT) this morning.

Queensland has the highest Christmas road toll at three .. two people have died in
both New South Wales and Tasmania .. and there's been one death in Victoria.

WA: WA wants more assurances on carbon trading impacts

PERTH, Aug 16 AAP - Western Australia will not commit to any form of national greenhouse
gas emissions trading without assurances that the state's interests won't be adversely
affected.

Premier Alan Carpenter says a National Emissions Trading Taskforce discussion paper
on the plan had raised a number of concerns for WA, including how it would impact on the
state economy and consumers' electricity costs.

"I would also want assurances that any trading scheme would not adversely impact the
state's capacity to rely on energy sources such as coal," Mr Carpenter said.

"In addition, there needs to be a reasonable level of acceptance of the national emissions
trading scheme model by WA industry."

These concerns would need to be addressed before we would consider entering a national
emissions trading scheme, he said.

Mr Carpenter said a lack of engagement in the Taskforce by the federal government would
severely weaken the prospects of the proposed scheme being successful.

WA was already playing its part to reduce greenhouse gas emissions by exporting greenhouse-friendly
fuel to some of the world's largest greenhouse-emitting nations, he said.

The discussion paper prepared by state and territory governments on a possible future
national greenhouse gas emissions trading scheme was released today.

Under the scheme, greenhouse gas emissions from Australia's electricity industry would
be capped at between 1997 and 2000 levels by 2035.

KIM BEAZLEY says the Cole inquiry's terms of reference will protect JOHN HOWARD from
accountability .. if he's asked to give evidence.

Commissioner TERRENCE COLE has asked the PM to provide a written statement by 4pm (AEST)
tomorrow .. and there's a possibility he could be called to give evidence.

MR BEAZLEY says it's now clear the AWB scandal goes all the way to the top .. and it's
vital MR HOWARD forgoes what he calls the inquiry's rorted terms of reference.

He says unless the terms of reference are changed the truth will never be known.









Trade Minister MARK VAILE will appear before the inquiry later today .. while Foreign
Minister ALEXANDER DOWNER will appear tomorrow.

NSW: Terror accused Lodhi may face more than one trial

Sydney terrorist suspect FAHEEM KHALID LODHI could face more than one trial .. after
the crown agreed to try some of the charges against him separately.

LODHI .. a 35-year-old architect from Punchbowl .. is accused of plotting to bomb the
national electricity grid and Sydney defence sites.

He appeared in court today for a pre-trial hearing into nine charges .. including four
related to acts allegedly carried out in preparation for a terrorist attack.

Justice ANTHONY WHEALY was told the crown had agreed to a defence application for a
separate trial on the other five counts .. of making false statements under the ASIO Act.







Court staff will be screened as part of tight security arrangements when LODHI stands
trial on the four terrorism charges early next year.

NSW: Year 8 external science test to be introduced

SYDNEY, April 3 AAP - NSW will introduce a compulsory external science test for Year
8 government school students, the state government said today.

Premier Bob Carr said the test would be used to detect students who were falling behind
in science before they sat for the School Certificate in Year 10.

The test would be trialled over the next two years before being introduced in all schools
in 2007.

"The new test will provide an opportunity for teachers to intervene and tailor science
teaching to students' needs, preparing students for the school certificate and senior
science," Mr Carr said in a statement.

SA: Gunman outside Adelaide primary school

ADELAIDE, Dec 6 AAP - Students at an Adelaide primary school were locked inside their
classrooms today after a gunman was spotted nearby.

A police spokesman said a man was spotted with a firearm near the Greenwith Primary
School, in Adelaide's northeast suburbs.

Police cordoned off the area, the school was locked down and local residents were told
to stay in their houses.

Police were negotiating with the gunman, who was not believed to have threatened anyone,
the spokesman said.

GOVERNOR PATRICK KICKS OFF CONSTRUCTION ON ONE OF NATION'S LARGEST BROADBAND EXPANSION PROJECTS.

SANDISFIELD -- The following information was released by the office of the Lieutenant Governor of Massachusetts:

Governor Deval Patrick today joined public officials and firefighters at the Sandisfield Fire Department to kick-off construction of the MassBroadband 123 fiber-optic network project to expand broadband access to more than 120 communities in western and north central Massachusetts. The event marks the launch of one of the largest fiber-optic expansions under construction in the nation.

The 1,300 mile Internet backbone network will attract private investment and job opportunities, help local governments deliver services more efficiently, and will provide direct connections to the nearly 1,400 schools, libraries, hospitals and public safety facilities that currently lack reliable, affordable Internet service, including the Sandisfield Fire Department.

"For too long, families and businesses in western Massachusetts have lived without reliable and affordable high-speed Internet access," said Governor Patrick. "Today, as we commence the installation of more than 1,000 miles of fiber-optic cable across the region, we start the critical final step in delivering broadband access to everyone. The digital divide in Massachusetts is about to close."

"Our Administration is committed to making infrastructure investments that unlock private investment and innovation and create jobs in every corner of the Commonwealth," said Lieutenant Governor Timothy Murray. " MassBroadband 123 exemplifies that strategy, and we are getting results for the people and businesses of western and north central Massachusetts that have been unconnected for too long. Through broadband, we are giving our neighbors, small business owners, students, teachers, public safety officials and municipal leaders the tools they need to compete and thrive in today's global economy."

The Patrick-Murray Administration began work with the Legislature to expand broadband access across the Commonwealth during its first term, when Governor Patrick introduced and signed legislation to create the Massachusetts Broadband Institute (MBI), providing state capital funding for broadband-related infrastructure projects. These resources, combined with an effective partnership with the Obama Administration and the Massachusetts congressional delegation, helped the MBI secure multiple federal grants worth more than $80 million, including a $45.4 million American Recovery and Reinvestment Act award through the highly-competitive National Telecommunications and Information Administration (NTIA) Broadband Technology Opportunities Program (BTOP).

The BTOP funds will be used to complete the MassBroadband 123 project which, over the next two years, will put hundreds of people to work building a fiber-optic network to serve 333,500 households and 44,000 businesses in an area with more than one million residents. The MBI, the Commonwealth's Information Technology Division, and the Executive Office of Public Safety and Security are providing $26.2 million in matching funds for the project.

"Governor Patrick deserves an immense amount of credit for keeping good on his word to bring broadband to central and western Massachusetts," said Congressman John Olver. "His leadership, along with the American Recovery and Reinvestment Act dollars dedicated to this crucial project, are making broadband a reality. This investment will strengthen our economy, make our communities safer and improve our children's educational opportunities."

To expand high-speed Internet access in the region, the MBI will attach fiber-optic cable to 35,000 existing utility poles in the project's service area. The MBI recently signed an agreement with G4S Technology, LLC to serve as the design-builder for the MassBroadband 123 network. Under the agreement, G4S will complete the final design, engineering and construction of the fiber-optic Internet backbone. The MBI is a division of the Massachusetts Technology Collaborative (MTC), a public economic development agency chartered by the Commonwealth to spur innovation across the state. The MTC will own MassBroadband 123 and work with G4S to oversee the final design and construction of the network, which is expected to be completed by June 2013.

G4S Technology has expertise in successfully designing and building broadband networks, and has deployed over two million miles of fiber in more than 200 rural and metropolitan areas, including 55 miles of fiber-optic cable along I-91 in Massachusetts from the Vermont to the Connecticut borders. The fiber along I-91 is a key component of the MassBroadband 123 network and was built through the MBI's partnership with the Massachusetts Department of Transportation.

The MBI is currently working with broadband service providers in western and north central Massachusetts to expand broadband connectivity. In March, the MBI signed an agreement with Axia NGNetworks USA to serve as the network operator for the MassBroadband 123 network. Axia will provide wholesale services on the network to broadband service providers and maintain and refresh the fiber-optic network to ensure its operability and efficiency. Axia is committed to investing $35 to $45 million in the operations and expansion of MassBroadband 123 , which will generate economic growth in the region and spur investment by broadband service providers. The MassBroadband 123 network will be open to allow any broadband provider to connect and offer its services, increasing competition and affordability for broadband customers.

Customs officers were told their lives were in danger if they continued to try and search a Syrian passenger, according to testimony at the Dubai Court of First Instance.The student, 22, was travelling through the airport in September last year when he was stopped. "When I start searching him he refused and started yelling," one of the Customs inspectors said.

"He said that he had drugs in his case and would rip open the neck of the person who searched the bag.

"He said: 'I will kill the person who searches my bag I will cause a disability for the person who searches me'."

He is alleged to have continued mocking the officers, saying neither the Dubai or Syrian police had the authority to search him. After his arrest no drugs were found in his belongings.The suspect denies threatening the officers

and the trial continues.

BizBuySell.com Third Quarter 2009 Data Signals Improving Business-for-Sale Market.

Business-for-sale transactions begin to increase after hitting bottom in recent months.

San Francisco, CA (PRWEB) October 6, 2009 -- BizBuySell.com -- the Internet's largest marketplace for buying or selling a small business -- today released economic data for the third quarter of 2009.

After multiple quarters of declining business-for-sale transactions, the new numbers suggest that the state of the small business economy is finally beginning to improve.

BizBuySell.com's new Third Quarter 2009 Insight Report shows a 24% year-over-year drop in closed small business transactions. While still lagging behind year-ago transaction numbers, BizBuySell.com's previous report -- which included data for the second quarter of 2009 -- showed a dramatic 50% decline in closed business-for-sale transactions when compared to the same time period in 2008. Closed transactions are reported to BizBuySell.com by business brokers nationwide.

BizBuySell.com's quarter-over-quarter data also supports the rebound in the business-for-sale marketplace. The number of closed transactions reported in the third quarter increased by 7.4% as compared to second quarter transactions. Just one year earlier, when the recession was hitting its stride, that same quarter-over-quarter statistic dropped 30%.

"After many bleak months for the small business-for-sale economy, the market seems to have hit bottom and is fortunately now beginning to turn around," says Mike Handelsman, General Manager of BizBuySell.com. "As credit eases, business fundamentals recover and SBA lending criteria change with respect to goodwill, we are optimistic that the fourth quarter of this year and the first quarter of 2010 will show increased signs of recovery and growth."

Closed Transactions Increase as Pricing Drops

BizBuySell.com's third quarter data suggests that business sellers are dropping their prices, which is making it possible for more deals to close. For example, the median sale price for closed transactions fell to $149,000 from $189,500 year-over-year, a 21.4% decline in price.

The metrics used to value companies have seen a similarly dramatic downward trend. Revenue multiples on reported closed transactions dropped 9.6% to .62 in the third quarter of 2009, and cash flow multiples dropped to 2.44, a 12.2% year-over-year decrease. The revenue and cash flow multiples are calculated by dividing the selling price of the business by its reported annual revenue or cash flow.

"These year-over-year price declines are dramatic, and suggest there are good deals out there for potential business buyers," says Handelsman. "With unemployment at record high levels, and SBA lending loosening beginning in Q4, this decrease in pricing and valuation numbers has made the prospect of purchasing a business much more achievable to buyers."

Business Brokers Optimistic About Business-for-Sale Transactions

A recent BizBuySell.com survey of business brokers around the country similarly revealed that they are positive about the future of small business transactions:

--- 34% of business brokers reported expecting to close their next deal within the next few weeks.

--- 75% of survey respondents expect to close their next small business transaction within the next three months.

--- 47% of survey respondents believe small business transaction levels will not fall any further than they were during the second quarter of 2009, which leads 78% of survey respondents to believe that business-for-sale transactions will begin to increase again before Q2 2010.

Change one thing for a better 2007.

Considering how challenging this year has been, I'm sure most of you are ready to close the books on 2006 and turn your attention to the possibilities the clean slate of 2007 may offer. But flipping the page of a calendar is not a silver bullet. Many issues the industry grappled with in 2006 will be waiting for us in 2007.

Even so, what would happen if you committed to change just one part of your business in order to improve it? Looked at another way, what about your business is likely to improve if you don't change any part of it?

Let's take a broad look at the Internet strategies currently utilized by most retailers as one possible area of your business to rethink. On a positive note, by adding click to the brick, retailers have positioned themselves to serve a broader group of customers.

But Internet initiatives often merely mirror what's available in their stores. In other words, their Web sites bring no value-added components.

Take a quick look at the Web strategies of Costco and Wal-Mart to understand why their e-business is off the charts.

Costco initially offered shoppers a tightly edited assortment of name-brand furniture in its stores. Since then, it has opened a few freestanding home stores devoted to furniture and related accessories.

But when it launched its Web site, it did something very clever. Rather than simply duplicating its brick-and-mortar mix, Costco focused its online store on higher-priced goods. This has allowed it to offer higher-margin goods, and created upper-end line extensions in categories solidly established in the stores.

Currently, Costco successfully sells a Premiere Leather four-piece power home theater set for $3,999, Sealy mattresses for $2,295 and a Grand Brittany entertainment wall at $3,199.

Similarly, Wal-Mart, known for years as the low-price provider, also is using the Web to sell higher-ticket goods. In bedding, for example, it offers a healthy assortment of better mattresses, including a Simmons model selling for over $3,000.

Rethinking your Web site is just one example of how you can enhance your business next year. Take the challenge: Commit to changing one thing about your business in 2007. And let me know what happens. I'd enjoy sharing your success in a future column.
